Implementation of Department of Labor Overtime Rule Halted
Following up on the webinar we presented in August on the overtime rule that was issued by the Department of Labor in May, we wanted to inform the field that a federal judge in Texas has issued a nationwide injunction to halt the implementation of this rule. The injunction is effective immediately—which means that the December 1st deadline for the regulation to take effect is now on hold indefinitely.
The case was brought by 21 states that argued the administration exceeded its statutory authority in raising the salary limit. There is not a clear timetable yet for the judge to rule on whether this rule may take effect at a later time.
The Council will be sure to keep the field updated as more information becomes available. As always, Council members can send questions to our attorneys at legal@cof.org for general guidance and tips.
